TERMS & CONDITIONS of St Andrews Taxicab

1. St Andrews Taxicab and its service partner’s terms and conditions.

These terms and conditions are applied to the web-based booking form along with any telephone bookings or any other means of booking and constitute the entire Agreement concerning the provision of taxi service (“Service”) between you or your company and St Andrews Taxicab and its service partners.

Completion of the booking form or booking via phone or any other means of booking and subsequent use of the Service indicates your unconditional acceptance of the terms and conditions set out in this Agreement.

It is understood that you are at least 18 years old and possess the legal authority to use our services or if you are less than 18 years old you may only use this service in conjunction authorization of your parents/guardians.

“St Andrews Taxicab” is based in St Andrews, and Scotland.

“You” and “your” means any individual, company or other business that places the booking with us.

2. Bookings, Prices& Payment.

2.1     If you are travelling within 24 hours then please call +447743322099 to book.

2.2    St Andrews Taxicab will not carry more passengers than its insurance or licensing allows.

​2.3    Bookings can be placed via duly filled quotation/booking form.

​2.4    St Andrews Taxicab and its service partners will email you a quotation based on the information supplied by you. St Andrews Taxicab and its service partners may amend the quotation if there is any material change to the original itinerary, the number of passengers, or the type or size of vehicle required.

​2.5    If you accept the quotation, you will receive confirmation of your booking a by email. Please check you’re booking confirmation carefully and inform St Andrews Taxicab and its service partners immediately of any errors. St Andrews Taxicab and its service partners shall not be responsible for any delays caused or costs arising from by your failure to provide St Andrews Taxicab and its service partners with correct information.

​2.6    Payment instruction will be sent via link or to your phone has to be made in to secure your booking at least 7 days before the date of travel.

​2.7    During journey due to unforeseen circumstance any road or road bridge is closed  and  detour is required to  reach your destination  it will affect your fare even if is fixed at the start.

​2.8    You must order a suitable car size for the number of passengers and luggage. St Andrews Taxicab and its service partners cannot guarantee to carry excessive amounts of luggage. Please note that a child, no matter what age, counts as one passenger.

​2.9    Where waiting time of 5 minutes or more duration after the due time is incurred at the pickup location, an additional charge for all waiting time may be levied.

​2.10 Special charges such as surcharges may be incurred for all bookings commencing outside of the relevant Licensing District. The remission of such charges and the amount charged will be entirely at the discretion of ‘St Andrews Taxicab and its service partners’

3. Your Obligations

You are obligated to complete the transaction with St Andrews Taxicab and its service partners if you accept the terms, unless the transaction is prohibited by law or by this agreement. By accepting St Andrews Taxicab and its service partners  terms, You agree to be bound by the conditions of the fare included in the fare details so long as the trip details are not in violation of this agreement or unlawful.

4. Your responsibility

4.1    You shall be responsible for the behaviour of all the passengers in the vehicle during the journey. You will be charged £100 to cover cleaning costs and loss of business in the unlikely event of the vehicle being soiled by any passenger.

4.2    Eating, drinking and/or smoking in the cars are not permitted.

4.3    All luggage’s is carried entirely at your risk and It shall be for to ensure that any valuable, unusual, precious, sentimental or any other items or articles owned by them are covered by their own appropriate insurance in transit.

​4.4    the ‘Client’ and/or their passenger(s)responsibility to count their luggage when you board or alight taxi, St Andrews Taxicab and its  service partners cannot accept any claim for loss or damage to any items or articles carried in the vehicles they operate or otherwise coming into their possession or control, howsoever caused.

4.5    St Andrews Taxicab and its service partners will deposit items left with local police authorities but if passengers or client gets in touch then reasonable steps will be taken to return property accidentally left in their vehicles. The ‘Client’ and/or their passenger(s) will be charged as per meter if a driver undertakes a journey to return the belongings.

4.6    No reasonable request to carry articles in the passenger compartment of the vehicle will be refused. However, this decision will be at the discretion of the driver, who will expect items that are bulky or have the potential to cause harm will be stored and carried in the luggage compartment.

5. Your data

5.1    St Andrews Taxicab use information you give us lawfully and in accordance with the Data Protection Act 1998. Your personal data is stored securely to prevent any unauthorized access to it.

5.2    You are giving St Andrews Taxicab the consent to use your information while completing web based quote/booking form or booking via phone, email which may include an attachments or any other mode of communication.

5.3    To provide you with service St Andrews Taxicab will share information provided by you with another service partners when need arises. Information shared with the service partners will have information about lead passengers name, numbers of passengers, pick up location, date and time along with drop of address and luggage details.

5.4    St Andrews Taxicab and service partners will not accept bookings unless the necessary consents required by the provisions of the General Data Protection Regulations (EU Directive 2016/679) are given freely, and, where applicable.

5.5    St Andrews Taxicab and its service partners will, safeguard your personal information it receives in accordance with its Policy on Data Protection and will use the information for booking, administrative and financial records purposes.

5.6    If you like to access information held about you as per the data protection act 1998, has to be in a form of a handwritten correspondence along with two latest photographic identification which also shows your address. Since looking for information requested will take some time and efforts for which a fee of 100% has to be paid in advance.

5.7    If St Andrews Taxicab decides to sell its business then in which case, St Andrews Taxicab might have to disclose information to the buyer which may include your personal data.

5.8    St Andrews Taxicab and its service partners will have to share and disclose information to legal authorities to comply with legal obligations or in order to enforce or apply our terms and conditions; or to protect our rights, property, or safety, or those of our customers or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

5.9    If St Andrews Taxicab receives requests from police, enforcement agencies or government departments for information we will be obliged to provide information to the organisation asking for it.

5.10 St Andrews Taxicab uses search engines and its services provided by them to understand use of our services; it collects information sent by your browser as a part of web-page request, IP address and cookies. information of your visit to our site including but not limited to , traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise and the resources that you access.

5.11 While you browse our site we may collect information about your IP address, operating system and browser type from your computer for system administration and to report aggregate information to our advertisers. This is a statistical date about users browsing actions and patterns and does not identify any individual. We may keep details of any correspondence, transactions carried out from our site to fulfil your requirements.

5.12 Internet being the most preferred way of communication which involves  flow of information different parts of the continents with the reference to your quotation/bookings or whether you are seeking any information  depending where ever you are located, unfortunately internet is not completely secure, although we employ security measures to protect your personal data, we cannot guarantee the security of your data transmitted via our web-page or any form of transmission, its completely at your own risk. Once we have received your information we will use stringent measures and security feature to prevent any unauthorized access.

6. Termination of service

St Andrews Taxicab and its service partners will refuse or terminate any booking with immediate effect if it places any driver or vehicle at risk of damage, violence or abuse by you or by any passenger in your party and we will ask all passengers to vacate the vehicle as soon as it is safe to do so.  No refunds will be given if the journey is terminated part way through the hire.

7. Child seats/ restraints

UK law states that taxis are exempt from legislation relating to children travelling in a baby/child seat or booster. All children travelling during the journey should be restrained by their parents.

Parents can bring their own child seat and fit it themselves; driver is not responsible for it. During the process of fitting the child seat if vehicle is damaged then passengers will be charged accordingly.

However upon request St Andrews Taxicab and its service partners may be able to supply child seat for a charge depending upon the availability, St Andrews Taxicab and its service partners or its service provides don’t take any responsibility towards any health and safety issues.

8. Airport Transfers

8.1    You must allow sufficient time when booking your taxi to allow for the check-in times required by your airline and for any delays caused by traffic conditions. St Andrews Taxicab and its service partners will not be responsible for any delay caused by your failure to allow enough time to reach your destination or if the passengers are not ready for collection at the booked time.

​8.2    For airport pick up St Andrews Taxicab and its service partners will endeavour to check for flight delays before the driver leaves for the airport but shall be under no obligation to do so.

8.3    The quotation will includes maximum waiting time of 30 minutes, driver will be in touch 15 minutes after flight land via  phone or text (calculated from flight landing time), if your phone is not reachable then St Andrews Taxicab and its service partners or its  service partners) cannot be held responsible.

8.4    Driver will meet you at the pickup zone of the airport.

8.5    Driver will only pay up to £5 as a parking charge anything extra has to be paid by the passenger.

8.6    Our Meet & greet services will be on request with additional charge of   £15/- Hour. Our driver will hold name board at the agreed meeting point which is normally inside airport terminal. Driver will assist you with your luggage and escort you to waiting vehicle.

9. Liability

9.1    Any quoted prices, pick up or journey times are best estimates only, utilizing the best technology available to us and based on known variables and logistical data at the time of booking. We offer quotes or fixed fares on the basis of the pick and drop off points stated to us at the time of booking, which does not include surcharges, extra stoppages or unforeseeable waiting time. 

9.2    St Andrews Taxicab and its service partners and its service partners will use all of its skills, local knowledge and reasonable efforts within the law to convey passenger(s) to their destinations in the shortest possible time and via the most cost-effective route, St Andrews Taxicab and its service partners shall have no liability if a pick up or journey time exceeds any estimate given, or otherwise exceeds the ‘Clients’ or their passenger’s expectations for whatever reason. Nor shall ‘St Andrews Taxicab and its service partners’ have any other liability to the ‘Client’ or their passenger(s) in connection with the time at which the passenger(s) reach or fail to reach the intended destination.

​9.3    St Andrews Taxicab and its service partners  shall have no liability for any damage, loss, costs, claims or other expenses, (whether foreseeable or not), that may accrue as the result of a late arrival, where all reasonable efforts have been made by the ‘ Company’ to fulfil the ‘Clients’ requirements, and it is deemed by the ‘Company’ through the investigation of root cause  analysis, that circumstances beyond the reasonable control of the ‘Company’ has been the cause of such loss, costs, claims or other expenses.

10. Cancellations and refunds

If you need to cancel your booking, please contact St Andrews Taxicab and its service partners as soon as possible.  If you cancel a booking after the vehicle has been dispatched then a charge may be incurred; the charge will be based on the distance/time that the allocated driver has travelled/spent prior to the point of cancellation.  As a general rule journeys from airports are dispatched up to two hours before flight arrival, journeys within the surrounding area of St Andrews are normally dispatched up to twenty minutes before their due time.

11. Affiliates and Third party sites

Our site may contain links to and from affiliate programs, other websites, advertisers and other third parties. If you follow a link to any of these websites, please note that they have their own privacy policies and that we do not accept any responsibility or liability for these policies, or incur any kind of loss.

Please check these policies before you submit any personal data to these websites.

12. Miscellaneous

12.1 St Andrews Taxicab and its service partners offer bookings under this agreement to self employed drivers and other associates and act as agent on their behalf.  You shall not assign, transfer or delegate any of your rights or obligations under this Agreement.

12.2 This Agreement and any accompanying quotation represent the entire agreement between you and St Andrews Taxicab and its service partners in relation to its subject matter. If there is any discrepancy between the terms of this Agreement and the quotation, the terms of this Agreement shall prevail.

​​12.3 Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.

12.4 St Andrews Taxicab and its service partners shall be entitled to cancel all services and provide refunds in the event of a declared national emergency, riot, war, fuel shortage, extreme weather or terrorist attack, or other circumstances beyond its control.

​​12.5 If the car breaks down during your journey St Andrews Taxicab and its service partners will endeavour to arrange an alternative car to complete the journey as soon as practicable.

12.6 You shall indemnify St Andrews Taxicab and its service partners against all losses, costs, damages and expenses arising from any act or omission of any passenger in your party.

12.7 Neither party excludes or limits its liability for death or personal injury caused by negligence, or for wilful default or fraudulent misrepresentation or otherwise in any manner unenforceable by any applicable law.

13. Complains

13.1 The ‘Client’ and/or their passenger(s)   shall notify St Andrews Taxicab and its service partners of any prospective claim or       complaint as soon as possible and in any event within one month of the date of the journey or, if later, the first date on which the ‘Client’ and/or their passenger(s) became aware of, (or if sooner should have been aware of), the matter claimed or complained of.

13.2 St Andrews Taxicab and its service partners undertakes to investigate all matters claimed or complained of free of charge if within the maximum one-month period allowed, but it will only investigate matters outside of this period if there is a legal request made, or there is a sufficient or compelled reason for doing so and charges for this service may be invoiced accordingly.

14. Disputes

This Agreement shall be construed in accordance with Scottish law and you and St Andrews Taxicab and its service partners each agree to submit to the exclusive jurisdiction of the Scottish Courts in respect of any dispute or claim arising out of or in connection with this Agreement.

15. Changes to our terms and condition

St Andrews Taxicab may change or update these terms and conditions at any time by posting changes online.  Please review these terms and conditions regularly to ensure that you are aware of any changes. All existing bookings will be at the rate quoted or applicable rate in effect at the time of booking.
